New Law – Toxicology Code of Traffic Regulations

With the passage ofLaw No. 14,071/20, which will take effect on April 12, 2021, and aims to amend various provisions of the Brazilian Traffic Code (CTB), severalnew rules regarding periodic toxicology testing have also been modified,therebyaffectingmany Brazilian drivers, particularly those in categories C, D, and E.

Thus, among the main changes provided for in the new law on periodic toxicology testing are: toxicology testing every two years and six months for drivers under the age of 70; a very serious violation for anyone caught driving without having undergone the periodic test within 30 days of the established deadline; a fine multiplied by five and a three-month suspension of driving privileges.

With regard to toxicological testing procedures—such as sample collection (hair and fur), the detection window (90 to 180 days), and the drugs tested—the rules remain unchanged.

Toxicology screening every 2 years and 6 months

As mentioned earlier, one of the new rules regarding periodic toxicology testing pertains to the deadline for renewing the test.

According to the new amendments to the CTB law, as set forth in Article 148-A, paragraph 2,drivers holding Class C, D, and E licenses who are under 70 years of age must undergo a toxicology test every 2 years and 6 months, regardless of the validity of their driver’s license or the results of their physical and mental fitness exams.

Drivers over the age of 70 will not need to take the exam again before their driver’s license expires.

However, it is also worth noting an important provision of the new traffic law, which concerns theextension of the driver’s license validity period. In light of this extension, the periodic toxicology test for categories C, D, or E must be conducted under the following conditions:

  • Drivers under the age of 50 must renew their national driver’s license (CNH) every 10 years. However, during the license’s validity period, drivers must undergo a wide-window toxicology test every 2 years and 6 months (which amounts to four tests during the license’s validity period).
  • Fordrivers aged 50 or older but under 70, driver’s licenses must be renewed every 5 years. However, a toxicology test is also required every 2 years and 6 months. (In other words, the test must be taken twice during the license’s validity period.)
  • Finally,drivers aged 70 or older must renew their driver’s license every 3 years. However, for these drivers, the toxicology test may be administered at the time of license renewal.

A very serious offense for anyone who drives a vehicle without having renewed their toxicology test

One of the new rules regarding toxicology testing that was added to the new Traffic Code (CTB)through Article 165-B concerns the imposition of a very serious traffic violation on the driver. 

Under the law, any driver caught operating a vehicle that requires a Class C, D, or E license without having undergone a toxicology test every 2 years and 6 months (for drivers under the age of 70), 30 days after the expiration of that deadline, will be issued a very serious traffic violation.

Also pursuant to Article 165-B,the same penalty will apply to drivers engaged in paid work (professional drivers in categories C, D, or E) who fail to provide proof of having undergone the periodic toxicology test required by law.

Fine and suspension of driving privileges for failure to renew the periodic drug test

The new rules for periodic drug testing also provide for other penalties for drivers who fail to renew their drug test within the established timeframe (2 years and 6 months for drivers under the age of 70), suchas a fine multiplied by 5 (R$ 1,467.35).

In addition,the new law on toxicology testing also provides for a three-month suspension of the right to drive. In thiscase, the suspension will be conditional on the negative toxicology test result being entered into the RENACH database; in other words, it will only be lifted once the driver submits a new toxicology test with a negative result, thereby allowing the driver to resume driving normally.
